Banks County

 

This indenture, Made this 14th day of May in the year of our Lord One Thousand Eight Hundred and Eighty-one, between Philip Fagans of the County of Hall of the one part, and Moses C. Fagans of the County of Banks of the other part: That the said Philip Fagans for and in consideration of ten Dollars for and in consideration of the same of natural love and affection he bears to his son, Moses C. Fagans the receipt whereof is acknowledged, granted, bargained, sold and conveyed by these present does grant, bargain, sell and convey unto said Moses C. Fagans his heirs and assigns, all that tract or parcel of land lying in the County of Hall, said State. The same being a part of the place owned by me and being all of that portion of said tract on the South East side of the Atlanta and Charlotte Airline Railway adjoining lands of Cagle, said Philip Fagans and others supposed to contain forty acres more or less.

 

To have and to hold the same above described premises with all and singular the rights, members, and appurtences thereof to the same being, or in anywise appurtening, to the only proper use, benefit and behoof of him, the said Moses C. Fagans, his heirs, executors, and administrators, the said bargained premises unto the said Moses C. Fagans, heirs, executors, administrators and assigns, against the said Philip Fagans, his heirs, administrators, and all and every person or persons, shall and will warrant and forever defend, by virtue of these presents.

 

In witness whereof, the said Philip Fagans has hereunto set his hand, and attached his seal, the day and year first above written.
