I General Whitner Davis of said county and state being of sound and disposing mind and memory do make this my last will and testament.

 

Item first: I give bequeath and devise to my wife Mary E. M. Davis, the following property to wit:-One tract or parcel of land adjoining the home-place now occupied by my said wife on which I now reside-also adjoining land of B. F. Brady, the Barnabas Garrison land and J. G. Chambers-containing twelve and one fifth acres, One two horse wagon and harness, Two horse mules, one of___ color and one of mouse color-about eight years old, Hogs, Cattle, Farming and mechanical tools, Household and kitchen furniture and whatever property I may have at the time of my death, free from all charges or limitations whatever to her own proper use benefit and behoof. This bequest is made to my said wife because of my desire to convey unto her all of my effects, for the love and affection I have for her and because of her kindness and attention to me.

 

Item Second: I hereby constitute and appoint my wife Mary E. M. Davis Executrix of this my last will and testament.

Signed declared and published by General Whitner Davis, as his last will and testament in the presence of us the subscribers who subscribe our names hereto in the presence of said testator, at his instance and request, and of each other he signing in our presence and we signing in his presence.

I R. M. Kesler do swear that I, as well as D. H. P. Garrison & M. J. Ragsdale saw the within named General Whitner Davis sign and publish the within attached paper as his last Will and Testament; that I subscribed the same as witness thereto at the special instance and request of the said General Whitner Davis and in his presence, as did D. H. P. Garrison & M. J. Ragsdale in the presence of the testator and of each other; that the said General Whitner Davis signed the same freely and voluntarily, and was, at the time fo such signing, of sound and disposing mind and memory.
