To the ordinary of said county the petition of Nancy
Fagan widow of James Fagan late of said county deceased showeth that on the 17th
of August, 1872, James Fagans departed this life leaving your petitioner his
widow and that the estate of said James Fagan is not worth more that five
hundred dollars and your petitioner prays that a year’s support may be set
apart to her under the act of 1838 and the various amendments to it the amount necessary
for the support and maintenance of said widow for the space of twelve months,
and further require said appraisers to return to you for record their
proceedings, as your petitioner will ever pray.

The application of Nancy Fagans, widow of James Fagan
deceased, having been read and considered, it is ordered by me in order that
the provision due the widow may be lawfully set apart that Isaac B. Lawrence,
Richard L. Hooper, Thomas B. Griffin, C. M. Cash and Turner Lane as a majority
of them taking in consideration the circumstances of the said James Fagan
family and estate and assess for his widow a sum necessary for her support and
maintenance for twelve months from this date and set apart that amount in money
or such property as the widow may select at a fair Evaluation does not amount
to more than five hundred dollars, then in that case set apart the whole of
said estate for the support and maintenance of the widow, and return to me
within the time prescribed by law a schedule fo the property or amount in money
so set apart for support and Maintenance to be recorded and that said
appraisers shall receive for their services from the funds so set apart each the
sum of one dollar.

dollars and was set apart to your petitioner for a support including the land,
which your petitioner prays that a citation may issue notifying all persons of
this my application for leave to sell and your petitioner will ever pray.

Now comes Nancy Fagan widow of James Fagan deceased of
this term of court and prays of the dismission of application made by Nancy
Fagan widow of James Fagan for leave to sell the real estate of James Fagan
deceased.
Ordered by the court that the application made by
Nancy Fagan widow of James Fagan for leave to sell the real estate of James
Fagan is and hereby remanded [or demanded] and that Nancy Fagan pay all costs
of said application.
